Many people ask me if they have an arrest record. The simple answer is, if you have been arrested for something, then yes, you have an arrest record. That arrest record is always going to be there unless you take some action, independently, to have it sealed up. The technique is called expungement. A lot of people will ask me if an arrest record will simply go away after 10 years. No, it will not. You have to take some independent action on your own to actually seal your arrest record. Most offenses in the state of Oklahoma are eligible for expungement; it’s just a matter of when. Some instances, you can petition the court to seal your record almost immediately after your arrest. Sometimes you have to wait two years, sometimes 10 years. Some offenses are never eligible for expungement; that record will always remain.
