Robbery is defined under Oklahoma law as the wrongful seizing of property in another person’s possession or presence against his or her will.  Fear or force must be used to constitute an act of robbery.  In addition, the property must be wrongfully seized with the victim’s knowledge.  Each of these elements will be molded and argued by the prosecution and defense attorney according to the individual facts and circumstances of each case.

Robbery in the First Degree

Oklahoma defines robbery in the first degree as a robbery that results in either actual serious physical injuries or the threat of serious physical injuries to the victim.  Additionally, robbery in the first degree is characterized by placing the victim in fear of serious and immediate physical injuries.  Robbery in the first degree also includes a robbery that is accompanied by a threat or actual commission of a felony in order to seize the victim’s property.  First-degree robbery is punishable by a minimum sentence of ten years to life in the Oklahoma State Penitentiary. You must serve 85% of your sentence before being eligible for parole.

Robbery in the Second Degree

Robbery in the second degree is a sort of catchall category for any robbery that is not specifically included in the definition of robbery in the first degree.  Robbery in the second degree is punishable by up to 10 years imprisonment in the state penitentiary.                 

Other Robbery Crimes

Other crimes that are associated with robbery are Robbery Committed by Two or More Persons and Robbery or Attempted Robbery with a Dangerous Weapon or Imitation Firearm.  Both of these crimes are felonies and are punishable by imprisonment in the state penitentiary.
