Question: What are the different types of restraining orders or protective that can be filed under Oklahoma law?
Answer: The general term that we use in Oklahoma, we do use the term restraining orders. A lot of times, though, we speak about protective orders. And protective orders can come in a couple of different fashions. There are permanent protective orders, there are temporary protective orders and there are emergency protective orders. An emergency protective order is the first step when somebody seeks a protective order. A temporary protective order is usually something which the court has put into place either by agreement of the parties involved, or the court on their own will issue a temporary protective order. And then if there are no violations for a certain period of time, the court will dismiss a protective order. A permanent order is just what it sounds like: it’s permanent, it’s in place for the rest of your life.
