Brandishing a Firearm in Oklahoma
Oklahoma has passed a considerable amount of legislation in support of our citizens’ right to own firearms. For those who are eligible and secure the proper permit, it is perfectly legal in our state to own and carry a firearm.
However, there are laws governing the way a firearm can be used in certain locations and situations. It is illegal in every jurisdiction in Oklahoma to brandish a firearm.
What is Brandishing?
The word “brandish” means to wave or shake in anger. Under the law, brandishing a firearm means displaying a weapon in such a way as to threaten or intimidate another person.
This means that you cannot:
- Point a loaded or unloaded firearm at another person (except in cases of self defense)
- Disturb the peace by threatening another person with a firearm
Penalties
Brandishing a firearm is a felony, punishable by up to 10 years in prison. In addition, with a felony conviction on your record, you will lose your right to own or possess a firearm in the future.
