What Are My Rights?
We often hear people say, “I didn’t get my rights!” Some rights are guaranteed by our Constitution, while others are derived by legal decisions.
The Miranda rights derive from a court case and are much more narrow than many people realize. These rights only apply once you are arrested and if questioning is taking place about a crime.
BUT, you have to USE them—that means you have to remain quiet. You cannot keep talking and expect to get the benefit of these rights.
If you want an attorney, you must CLEARLY say so. Statements such as: “I think I may want an attorney,” or “Can I get an attorney?”
DO NOT engage your rights under Miranda. You have to clearly and unequivocally request an attorney.
You must say,“I want an attorney,” simply and clearly. Then, be quiet.
